Child Pornography Crimes

Florida Statute 827.071(5) defines the offense of knowingly possessing, controlling, or viewing any media that depicts sexual conduct by a child. This is considered a third degree felony—but also note that each item of child pornography found (magazine, photo, etc.) counts as its own, separate offense.

While possession is very serious, participation in the production and distribution of child pornography is considered an even more severe offense. This includes:

  • Employing or permitting a minor for a sexual performance - 827.071(2)
  • Promoting the sexual performance of a child - 827.071(3)
  • Possessing media depicting the sexual performance of a child with intent to promote - 827.071(4)

These offenses are considered second degree felonies. In our digital age, it is now common for the "transmission" or sending of child pornography over the Internet. This can constitute a federal offense, which is subject to its own set of statutes and penalties. For more information on your child porn charges, what penalties you could be facing, and how our firm can mount an effective and assertive defense in your favor, contact us today. Whether your charges are on the state or federal level, our team can help.
