Attorney DeFabio Quoted in Article About Labor Secretary Acosta

Attorney Joel DeFabio of DeFabio, Beckham, & Solis was recently sought for his experienced opinion by The Mercury News, where he was quoted in an article for his opinion on the dramatic and controversial legal saga involving billionaire Jeffrey Epstein. Mr. DeFabio was sought by the newspaper for his renowned reputation as a Miami criminal defense attorney for sex crime cases.

The article discusses the tough questions that Labor Secretary-designate Alexander Acosta might face in his Senate confirmation hearings, which are set to begin soon in Washington D.C. According to the article, Acosta has been confirmed for three different federal posts, but will face scrutiny for the first time thanks to one of his decisions as Miami U.S. Attorney, pertaining to the Jeffrey Epstein case.

In this high-profile case, Epstein faced several charges of prostitution and solicitation of minors. Initial investigations by Palm Beach prosecutors opted to charge Epstein with aggravated assault, which would have meant no jail time and no mandatory sex offender registration. This prompted investigators to take up the issue with Acosta’s office, which then proposed an indictment that would have put Epstein in prison for 10 years to life. Eventually, the attorneys worked out a plea deal that saw Epstein plead guilty to prostitution and solicitation charges and be sentenced to 18 months in prison (of which he served 13) plus mandatory sex offender registration.

Afterwards, it was revealed that Epstein’s lawyers worked out a secret “non-prosecution agreement,” which guaranteed that neither Epstein nor his employees who he had helping him solicit the underage prostitutes would face any federal charges.

Attorney Joel DeFabio commented on this deal saying “There still has been no clear explanation as to why Epstein received such preferential treatment. This thing just stinks. The elite take care of their own.”

The questions Alexander Acosta is expected to face pertain to whether or not he will stand up for those who are in less-powerful positions, as many people believe he bended to the will of a powerful billionaire at the expense of those with less influence. Acosta has previously defended his position on the case in 2011, when he wrote “Our judgment in this case, based on the evidence that was known at the time, was that it was better to have a billionaire serve time in jail, register as a sex offender and pay his victims restitution than risk a trial with a reduced likelihood of success. I supported that judgment then, and based on the state of the law as it then stood and the evidence known at the time, I would support that judgment again.”
